2024 COX / OKLAHOMA CITY THUNDER FLYAWAY TRIP SWEEPSTAKES (“SWEEPSTAKES”) OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents residing in select zip codes within Arkansas, Kansas, and Oklahoma (see Appendix at the bottom of these Official Rules for eligible zip codes) who are eighteen (18) years of age or older at time of entry. Void where prohibited. Employees, officers and directors of Cox Communications (“Sponsor”), Genesco Sports Enterprises, Inc. (“Administrator”), each of their respective parent, subsidiary and affiliated companies, dealers, distributors, Web design, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively “Sponsor and Promotion Parties”), employees of NBA Properties Inc., NBA Media Ventures, LLC, the National Basketball Association and its Member Teams, and each of their respective parents, subsidiaries, and related companies and divisions (collectively defined as the “NBA Entities”), each of their respective IRS dependents, immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside), and individuals residing in their same household are not eligible to participate or win. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right, at any time, to verify eligibility requirements in any manner it deems appropriate. By participating, entrants agree to these Official Rules, which are final and binding in all respects.
2. SWEEPSTAKES PERIOD: The Sweepstakes begins on January 11, 2024 at 12:00:00 p.m. Central Time (“CT”) and ends on March 3, 2024 at 11:59:59 p.m. CT (“Sweepstakes Period”). The time clock of the computer administering this Sweepstakes is the official timekeeping device for this Sweepstakes.
3. TWO (2) WAYS TO ENTER: During the Sweepstakes Period, you may participate in the Sweepstakes in one of the following manners.
A. Visit the Cox Communications footprint outside section 115 at Paycom Center during a 2024 Oklahoma City Thunder home game and have your photo taken by Sponsor’s representative. The photo will be sent to your mobile device via text message. The text message will include a link with entry instructions. Click on the link within the text message to access the Website (defined below), and then follow the online instructions to complete and submit the entry form to receive one (1) entry into the random drawing.
You must have a mobile phone or other web-enabled device with text messaging capabilities to participate via this method. By participating via this method, you authorize Sponsor to send you up to three (3) text messages to the number you provide by auto dialer. Consent is not a condition of participation. Your text is your electronic signature agreeing to these terms and to giving electronic written consent. Message and data rates may apply. Check with your wireless service provider for details on these and other applicable charges. Entrants are solely responsible for any such wireless charges. Not all wireless carriers participate.
B. To enter without attending a game and receiving a text message, visit CoxThunderSweeps.com (the “Website”) and follow the online instructions to complete and submit the entry form to receive one (1) entry into the random drawing.
Limit one (1) entry per person/email address per day during the Sweepstakes Period, regardless of entry method. A “day” shall be defined as each calendar day, beginning at 12:00:00 a.m. CT and ending at 11:59:59 p.m. CT on that same day, except for the first day of the Sweepstakes Period which shall begin at 12:00:00 p.m. CT and end at 11:59:59 p.m. CT.
Each entry submission must be manually key stroked and/or manually entered by the individual entrant. All entrants must have a valid email address. Multiple entrants may not share the same email address. The potential winner may be requested to provide Sponsor with proof that they are the authorized account holder of the email address associated with the winning entry and/or an eligible entrant. Any suspected use of automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will disqualify such
entries and transmissions from these or related email addresses/IP addresses may be blocked. If it is discovered that an entrant attempted to use multiple email addresses, phone numbers and/or mailing addresses or manipulated such information for the purpose of obtaining more than the stated number of entries, such persons will be disqualified; their entries will be deemed invalid; and any prize won by such person shall be forfeited.
4. RANDOM DRAWING: The potential winner will be selected in a random drawing to be held on or about March 4, 2024 from among all eligible entries received by the Administrator whose decisions shall be final. Odds of winning depend upon the number of eligible entries received.
5. PRIZE DETAILS: One (1) prize is available to be awarded, consisting of a trip for winner and winner’s one (1) guest to New York, New York to attend the Oklahoma City Thunder vs. New York Knicks game (“Game”) on March 31, 2024 at Madison Square Garden. Travel dates: March 30, 2024 – April 1, 2024. Trip consists of round-trip coach air transportation from a major airport (nearest winner’s home); double-occupancy hotel accommodations for two (2) nights (one room); two (2) tickets to the Game; and one (1) $600.00 Visa® gift card (subject to terms and conditions as set by issuer). Approximate Retail Value (“ARV”): $5,000.00. Actual value may depend on city/date/time of departure.
Travel, accommodations, and Game are subject to availability and change. No alternative travel dates will be offered. If winner cannot travel on dates specified, prize shall be forfeited, and Sponsor shall have no further obligation to such individual. Tickets are subject to terms and conditions as stated on tickets. Tickets may be provided to winner via a mobile ticketing platform and are subject to terms and conditions of such mobile ticketing platform. Winner may be required to provide a valid email address, download the applicable mobile ticketing app to his or her mobile device, and present tickets at the venue via mobile device. Data rates may apply. Winner is solely responsible for any such wireless or data charges associated with such use, including the downloading and use of mobile ticket app (if any). Seating assignments are in Sponsor’s sole discretion. Tickets are not for re-sale and cannot be sold after they are awarded. Winner must book all travel arrangements in connection with the prize through Sponsor’s designated travel agent. Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled events (including, but not limited to airline flights or the Game) or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations beyond its control. Selection of airline and hotel are solely within Sponsor’s discretion. Ground transportation, meals, gratuities, luggage fees, and all other expenses not specified herein are solely the winner’s responsibility. Winner will be required to provide a credit card prior to check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. If a guest is a minor, the minor guest must be accompanied by their parent or legal guardian who must be the winner. Winner’s guest (or if a minor, a parent or legal guardian) may be required to sign and return a liability/publicity release before prize is awarded. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license, real ID or passport) required for travel. Winner and guest must travel on the same itinerary. Once the travel guest is selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged airline tickets, Game tickets, travel vouchers or certificates will not be replaced or exchanged. In the event the winner and/or the guest misses a scheduled airline flight (through no fault of Sponsor or Promotion Parties or due to Force Majeure), Sponsor and Promotion Parties will have no liability for any costs associated with changing or rebooking transportation. Additional prize details may be provided to the winner at the time of notification. Sponsor and Promotion Parties reserve the right to remove or to deny entry to winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or behaves with the intent to annoy, abuse, threaten or harass any other person at the Game. Winner agrees that acceptance of the prize is done so entirely upon their own initiative, risk, and responsibility.
Winner must accept prize as stated by Sponsor, or prize may be forfeited and awarded to an alternate winner. Any difference between stated value and actual value of the prize will not be awarded. Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. Taxes, if any, on prize are solely the responsibility of the winner. Winner shall be required to provide a valid social security number and shall receive an IRS 1099 tax form for the ARV of the prize.
6. GENERAL CONDITIONS: By participating in the Sweepstakes, entrants agree (and agree to confirm in writing, if requested): (a) to release and hold harmless Sponsor and Promotion Parties, the NBA Entities, and all of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) and that such Released Parties shall have no liability whatsoever for and against any liability for any injuries, losses or damages of any kind to person(s) including, without limitation, death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or any Sweepstakes-related activities including, without limitation, travel thereto; and (b) that, except where legally prohibited, the entrant confirmed as the winner grants (and agrees to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide in perpetuity, and on the Internet and World Wide Web, without notice, review or approval, unless prohibited by law.
Sponsor’s use of your personal information is subject to the privacy policy located at
https://www.cox.com/aboutus/policies/online-privacy-policy.html. Any communication between entrant and Sponsor or its agencies regarding this Sweepstakes (e.g. phone calls, text messages, chats, emails, etc.) may be recorded for quality assurance and training purposes. In addition, if you are selected as the winner, your information may also be included in a publicly-available winner’s list.
7. WINNER NOTIFICATION AND VERIFICATION: The potential winner will be notified by phone and/or email. The potential winner must accept the prize, as indicated within the notification message, within forty-eight (48) hours of notification or prize may be forfeited and awarded to an alternate winner. As part of the prize-claim process, the potential winner will be required to complete, sign and return an IRS Form W-9 (including their social security number) and an Affidavit of Eligibility/Liability Release with (where lawful) a publicity release (altogether, the “Affidavit”) within forty-eight (48) hours of receiving the email containing the Affidavit. Failure to return all required documents within the forty-eight (48) hour period may result in prize forfeiture and the awarding of the prize to an alternate winner. If any prize notification or prize is returned as undeliverable, if the potential winner does not properly claim their prize (as instructed within the notification), if the potential winner cannot be verified or is otherwise unable to accept the prize as stated or unable to attend an event on the date specified, prize may be forfeited. Upon forfeiture for any reason as stated within these Official Rules, no compensation will be given. sponsor and its agencies are not responsible for suspended or discontinued landline, wireless or online service which may result in a potential winner not receiving a prize notification; nor is Sponsor responsible for any change in entrant’s email address or phone number. Sponsor will attempt to notify the potential winner as set forth above, but Sponsor is not responsible for any undelivered emails, including without limitation emails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes email, including any winner notification email, to a spam or junk folder. If, after a good-faith attempt, Sponsor is unable to award the prize, the prize may not be re-awarded.
8. LIABILITY LIMITATIONS: Released Parties are not responsible for lost, late, misdirected, incomplete, illegible, damaged or non-delivered entries; or for interrupted or unavailable satellite, network, server, Internet Service Provider, Website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of an entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes or otherwise attempt to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like methods of submitting an entry will void all such entries by such methods, and disqualify any entrant using such methods. Released Parties are not responsible for injury or damage to entrant’s or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Website. Released Parties are not liable in the event any portion of the Sweepstakes (including prize) is cancelled, rescheduled, postponed or limited due to Acts of God, pandemics, epidemics, weather, fire, strike, acts of war or terrorism, government restriction, or any other condition beyond their control (a “Force Majeure Event”). Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security,
fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to suspend, modify or terminate the Sweepstakes, and select the potential winner in a random drawing from all non-suspect, eligible entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by Website users, human error, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of this Website. In case of dispute, the authorized account subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant, and must comply with these Official Rules. The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet Access Provider, on-line service provider, or other organization which is responsible for assigning email addresses.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. BINDING ARBITRATION: Any controversy or claim arising out of or relating to this Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Georgia law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty (60) days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
BY PARTICIPATING IN SPONSOR’S SWEEPSTAKES, EACH ENTRANT AND THE PRIZE WINNER AGREES (AND AGREES TO CONFIRM IN WRITING IF REQUESTED) THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED INCLUDING ANY TRAVEL OR PRIZE ACTIVITY RELATED THERETO, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT OR PRIZE WINNER BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT AND PRIZE WINNER'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.
10. GOVERNING LAW AND JURISDICTION: Except where prohibited by law, by participating, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Georgia without giving effect to any choice of law or conflict of law rules, and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of Georgia, in Atlanta, Georgia. By participating, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Atlanta, Georgia.
